Yankwitt LLP Secures Motion to Dismiss in Discrimination Lawsuit

A Yankwitt LLP employment litigation team led by partner Michael Reed achieved a significant victory in Westchester County Supreme Court employment litigation on behalf of our property management company client.

The plaintiff, a long-term employee, asserted eight causes of action arising from alleged workplace scent sensitivities. She claimed that exposure to perfumes and other fragrances in the office triggered physical reactions requiring medical attention and alleged that the company failed to provide a reasonable accommodation. The complaint included a primary claim for disability discrimination, along with causes of action for emotional distress and wage-related violations tied to an alleged reduction in her discretionary bonus.

After full briefing, the court granted Yankwitt LLP’s motion to dismiss the central disability discrimination claim in its entirety. The court also dismissed the remaining emotional distress claim and substantially narrowed the wage-related allegations.

As a result of the ruling, the case has been reduced from eight counts to a single dispute with limited exposure concerning a bonus the plaintiff claims was reduced as retaliation for filing the lawsuit. Yankwitt LLP looks forward to continuing its vigorous defense and successfully resolving the lone remaining claim.
