Older Adult Competency Evaluations

Increasingly, contracts signed by older adults are being legally contested in the courts. These contested matters challenge the signer’s mental capacity to engage in, or change legally binding contracts, wills, and other legal documents. It is a unique challenge: how can you ensure your client is mentally sound and understands the details of the legal document they’ve signed? The answer is for your client to undergo a brief, cost-effective, mental competency evaluation.

As a psychologist who has been licensed to practice in New York since 1991, Dr. Abrams has conducted thousands of psychological evaluations assessing people of all ages. I’ve recently begun a new tailored evaluation designed to address the mental competency question, which will enhance your level of service for this population.

These evaluations assess both testamentary capacity and contractual capacity for older adults. My standard procedure is to speak with the referring professional to understand context and history as it relates to the documents that are to be signed, before meeting with your client. In as little as one hour, I can evaluate most individuals. I use one of the best objective screening tools for identifying early signs of dementia in the elderly, along with a clinical interview. A report can be provided to you within several days (same day if necessary). This report will become part of the client’s file, which then protects the client against challenges to that person’s competency.
