Kathy Marks Joins the New York State Department of Health as GC

Yankwitt LLP is proud to announce that Kathy Marks, a partner with the firm for the past 10 years, has returned to government service in the prominent role of general counsel of the New York State Department of Health (NYSDOH).

In this important role, Marks is responsible for providing counsel to the commissioner of the NYSDOH on a wide variety of issues involving coronavirus regulation, hospitals throughout New York state, Medicaid programs, and the health insurance marketplace, among other things.

“While we are saddened to lose Kathy, we are thrilled she found a meaningful and vital role with the New York State Department of Health,” shared Russell Yankwitt, managing partner. “Kathy has been a tremendous asset to the firm, as counsel to our clients and as a peer and mentor to her colleagues. We will miss her and wish her success in her new position.”

A seasoned litigator, Marks tried numerous cases to verdict over her nearly 35-year career. During her tenure at Yankwitt LLP, Kathy focused on representing corporations and individuals in commercial litigation, employment disputes, fraud matters and premises liability defense. She also represented individuals in whistleblower actions under federal and state False Claims Acts, as well as tax and other whistleblower statutes. Since 2014, she has assisted the United States and the state of New York in recovering more than $100 million.

Marks’s departure comes at a time of significant growth for Yankwitt LLP. The firm recently hired partners Ross Morrison and Daniel Alter, former AUSAs, and counsel Ben Fishman, all of whom clerked for federal judges and worked with elite New York City law firms. With a full roster of highly credentialed attorneys, the firm is poised for the influx of high-stakes litigation expected in the coming year.
