Deep Dive Investigation Compels Plaintiff to Withdraw Toxic Tort Case
Fullerton Beck Partner Angelo Bianco’s deep investigative dive into liability and the plaintiff’s prior medical history compelled the plaintiff to withdraw her case against the firm’s client.
The plaintiff, a woman in her 20s and resident of Ulster County, alleged that she suffered from copper poisoning from tainted tap water being provided to her home by the defendant, causing her to become immuno-compromised and suffer from digestive and neurovascular issues. Angelo retained a liability expert early in the case, who tested the water at the treatment plant and in the plaintiff’s home and discovered copper and other metal levels to be below the minimum level required by law.
Additionally, the defense team’s comprehensive investigation tactics were able to discover that the plaintiff suffered from Wilson’s Disease, a rare inherited disorder in which an excessive amount of copper accumulates in the body.
