Yankwitt LLP Secures Pivotal Summary Judgment Victory in High Stakes Employment Dispute
Yankwitt LLP obtained a resounding summary judgment victory in the Westchester Supreme Court, Commercial Division on behalf of its client, the former CFO of a technology staffing company, in litigation against the company and its CEO.
Yankwitt LLP filed the lawsuit on behalf of its client after the company and CEO failed to pay him a severance payment pursuant to his employment contract and refused to recognize his interest in proceeds from software that he co-created. The defendants also asserted counterclaims against our client, alleging that he breached his contractual obligations and fiduciary duties to the company. Following discovery, the defendants filed a motion seeking summary judgment on all claims and counterclaims.
The Yankwitt LLP team, led by Counsel Jonathan Ohring, opposed the motion with a compelling brief, demonstrating numerous material issues of fact precluding judgment for defendants.
The Commercial Division issued a thorough, 69-page decision denying the defendants’ motion in its entirety and agreeing with Yankwitt LLP’s arguments that there was substantial evidence supporting its client’s claims and undermining the defendants’ counterclaims. The court has set the case down for a fall 2025 trial.
